The options for obtaining Spanish nationality have been expanded
With the Law of Democratic Memory, also called the ‘Law of Grandchildren’, the options for access to Spanish nationality are expanded.
According to the provisions of the Law of Democratic Memory, the descendants of Spaniards who had to leave the country between July 18, 1936 and December 31, 1955; and between January 1, 1956 and December 28, 1978, will be able to obtain Spanish nationality.
How to apply for Spanish nationality through kinship?
The procedure to obtain the Spanish nationality can be done at the Civil Registry of Spain or at the Civil Registry of the Spanish Consulate of your country of origin.
You will have to provide the official documentation that accredits your kinship link and the condition of exile of the ascendant.
Considering the dates, the three new assumptions that grant the obtaining of Spanish nationality with the approval of Law 20/2022 of Democratic Memory are:
- Born outside Spain whose father or mother, grandfather, or grandmother, was originally Spanish.
- Sons and daughters born outside Spain of Spanish women who lost their nationality by marrying foreigners before the entry into force of the Spanish Constitution in 1978.
- Sons and daughters of legal age of those who acquired Spanish nationality through the Law of Historical Memory.
Since its entry into force, the Law of Democratic Memory will remain in force until October 21, 2024 and there is the possibility of extending it for one more year in the event that the Congress approves it.
